    Can I get out of a roofing contract?
    I had major hail damage from a storm. A couple of days later a roofing company was going around checking roofs. He checked mine and said I had hail damage and I signed what I thought was just a form that I had hail damage for my insurance company (It was very hot and humid out and didn’t have power for 3 days so wasn’t up to reading anything). It actually was a contract to do the work. The problem is in the fine print it says I must give them the full amount I receive from the insurance company. I’m not out to rip-off the insurance company but I would like to get a couple quotes and maybe go with someone where I could cover my deductible. I feel like I was taken advantage of and feel soooo stupid for not reading what I was signing. I had 3 days to viod the contract but it took me 5 days to actually read it. Is it possible to somehow get out of this?

    Not unless you take legal action in court, and you would probably lose based on the story in your question.

    Check with the State to see if they are Licensed Contractors. If they aren’t tell the State about them. Also talk to a Lawyer.

    You can void a contract by agreement, so you could always call them up and ask them. There’s always the defense of mistake, though I’m not sure it would work since you merely skipped reading the form.

    If you did not give them any money I would tell them that you want more time , estimates, to compare. If they give you a hard time tell them to get lost they will never see a dime.
    If they want to play hardball get a lawyer!
    He is an independent contractor not part of the insurance company.

    Dear Stupidguy: That was dumb…but understandable. Follow some of the other suggestions, the first one being to see if the roofers are indeed licensed. Secondly, contact a lawyer: initial consultations are usually free, albeit of the 10-minute variety. Third, if you haven’t paid the roofers anything, you’re more in control of the situation than they are. These guys sound like predators who count on panic, stress and/or ignorance to take advantage of people. By remaining firm (and informed, as to their license status, Better Business Bureau record, etc.) you can probably fend them off and they’ll go away; they have other fish to reel in. And check with your insurance company about the proper procedure re: having work done and getting paid or reimbursed. The ins. co. might even have a list of approved roofers that they’ve dealt with or recommend.

    But please, don’t sign ANYTHING without reading AND UNDERSTANDING it.

    Here’s a little roofing contractor secret…
    Roofing contractors are required [by law] to provide insurance for all the workers that are working on roofs. The daily insurance premiums are ridiculous and usually cost more than the daily wage of a professional roofer, so most contractors dont have insurance on their workers. Also, some roofers could be illegal immigrants or are just day help, but thats a whole other topic. Either way, if the contractor doesnt have insurance for his workers, then they cant perform the work and technically THEY would be in breach of contract for fraudulently agreeing to perform the work illegally.
    Only problem is, if he does provide proof of liability for all his workers, you’re screwed.

    You could also tell him that you were drunk when you signed the contract. It sounds dumb, but it may ne sooo dumb that he opts out of the contract himself.

    Contact your roofing company and tell them what happen, see who they pay, you or the roofer. They may not pay you. Are you looking to make some money off this? is this the reason you want to get the check instead of the roofer.

    If anything, contact them and tell them what happen and you don’t want that company now, they still may hold you to the contract.

    It seems to me that this roofer needs to provide an estimate for your insurance company anyway. I don’t know of any insurance company that just hands out checks
